Robert Mitchell 

Robert Mitchell is a Marine Corps veteran who served with First Intelligence Company in an Interrogation Platoon while stationed at Camp Pendleton, and then later with the Special Operations Training Group while stationed in Okinawa, Japan. Mr. Mitchell is a graduate of Gonzaga School of Law and during his second and third years of law school, Mr. Mitchell clerked at the Washington State Attorney General’s Office in Spokane, Washington. Prior to receiving his JD at Gonzaga, Mr. Mitchell studied business at Arkansas State University. While at Arkansas State, Mr. Mitchell completed an internship with U.S. Senator Tim Hutchinson in Washington, D.C., and worked as a volunteer for two and half years assisting disabled veterans enrolled in the VA’s Vocational Rehabilitation Program. Robert has been practicing law for nearly two decades.

Mr. Mitchell uses the Uniformed Services Employment and Reemployment Rights Act (USERRA), the Servicemembers Civil Relief Act (SCRA), the Fair Credit Reporting Act (FCRA), and State Consumer Protection Statutes to protect members of the United States Military from abusive actions relating to employment, credit reporting, banking, debt collection, and other unfair and deceptive acts and practices.

Mr. Mitchell has effectively used USERRA to obtain relief for thousands of Servicemembers of the United States Military. In April of 2022, Mr. Mitchell, along with his co-counsel Thomas Jarrard and SaraEllen Hutchison, obtained a jury verdict of over $1.5 million against the Shelby County Sheriff, in Memphis, Tennessee, for terminating a servicemember’s employment while serving in the military during the war in Afghanistan.  

Mr. Mitchell also proved instrumental in resolving a $6.15 Million class action lawsuit against United Airlines for abusing Servicemember pilots’ rights in employment. A similar result ($6.5 million) was reached in a similar class action lawsuit against American Airlines. 

Additionally, Mr. Mitchell served as Amicus Curiae and helped change the application of USERRA in the State of New Mexico. Most recently, Mr. Mitchell served as Amicus Curiae in a class action lawsuit against the Washington State Patrol.  

From his offices in Washington State and Arkansas, Mr. Mitchell has litigated cases in federal courts throughout the nation, state appellate courts, and the Sixth and Ninth Circuit Courts of Appeal.
